Liability Waiver
Liability Disclaimer, Release of Claims, and Assumption of Risk Dubai & Abu Dhabi By Foot (“Dubai & Abu Dhabi By Foot,” “we,” “us,” or the “Operator”) arranges and markets guided tours and related experiences that are operated by independent guides and third-party service providers (collectively, the “Activities”). Dubai & Abu Dhabi By Foot does not own, operate, or control the Activities and does not employ the independent providers who conduct them.
Participation in any Activity is conditioned upon acceptance of this Liability Disclaimer, Release of Claims, and Assumption of Risk (“Agreement”).
- Assumption of Risk
Participant understands and acknowledges that participation in the Activities involves inherent
risks, including but not limited to walking on public streets and sidewalks, uneven terrain,
extreme heat and weather conditions, crowds, transportation-related risks, food consumption,
use of bicycles or other equipment, interactions with members of the public, and compliance
with local laws and cultural customs of the United Arab Emirates.
Participant voluntarily assumes all risks associated with participation, whether known or
unknown, foreseeable or unforeseeable, to the fullest extent permitted by applicable law. - Release and Waiver of Claims
To the fullest extent permitted by law, Participant hereby releases, waives, and forever
discharges Dubai & Abu Dhabi By Foot and its officers, directors, employees, agents,
representatives, and contractors from any and all claims, demands, causes of action, losses,
damages, injuries, or liabilities of any kind arising out of or relating to participation in the
Activities.
This release includes, without limitation, claims for personal injury, illness, death, property
damage, or economic loss, whether caused by negligence or otherwise, except where such
release is prohibited by applicable law. - Unknown Claims
Participant understands that this release applies to claims that are presently unknown or
unsuspected. To the extent permitted by law, Participant expressly waives any legal protections
that would otherwise limit this release to known claims only. - Indemnification
Participant agrees to indemnify, defend, and hold harmless Dubai & Abu Dhabi By Foot and its
officers, directors, employees, agents, and representatives from and against any and all claims,
damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising
out of or related to Participant’s actions, conduct, or participation in the Activities. - Third-Party Providers and Equipment
Participant acknowledges that certain Activities may include food tours, boat tours, desert
excursions, or other specialty experiences. Any food is prepared and provided by independent
third-party vendors. Any vehicles, watercraft, bicycles, or other equipment are supplied and
operated by third parties. Dubai & Abu Dhabi By Foot does not control these providers and is
not responsible for their acts or omissions.
This Agreement applies to any claims arising from the use of third-party goods or services
provided in connection with the Activities. - Compliance with Local Laws and Cultural Standards
Participant agrees to comply with all applicable laws, regulations, and cultural norms of the
United Arab Emirates, including the Emirates of Dubai and Abu Dhabi. This includes appropriate
dress codes at religious and heritage sites, restrictions on photography, and public conduct
standards. Participant acknowledges that failure to comply may result in removal from the
Activity without refund, and that Dubai & Abu Dhabi By Foot bears no liability for any
consequences arising from the Participant’s non-compliance. - No Admission of Liability
Participation in the Activities shall not be construed as an admission of liability or assumption of
responsibility by Dubai & Abu Dhabi By Foot for any damages, losses, or expenses arising from
Participant’s involvement in the Activities. - Minors and Parental/Guardian Consent
Participants under the age of eighteen (18) must be accompanied by a parent or legal guardian.
By accepting this Agreement on behalf of a minor, the parent or legal guardian represents and
warrants that they have the legal authority to do so and agrees to all terms on behalf of the
minor, including the release, waiver, and indemnification provisions. The parent or legal
guardian further agrees to indemnify and hold harmless Dubai & Abu Dhabi By Foot from any
claims arising from the minor’s participation in the Activities. - Electronic Acceptance and Signature
When this Agreement is accepted electronically—including by checking a box, clicking “I
Agree,” completing an online booking, or otherwise indicating acceptance—such action
constitutes the Participant’s legal signature and agreement to be bound by these terms to the
same extent as a handwritten signature.
- Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the United
Arab Emirates and, as applicable, the laws of the Emirate of Dubai, without regard to conflict-of-
law principles.
Any legal action or proceeding arising out of or relating to this Agreement or the Activities shall
be brought exclusively in the courts located within the Emirate of Dubai, and the Participant
hereby consents to the personal jurisdiction of such courts. - Relationship to Terms and Conditions
This Agreement is incorporated into and forms part of Dubai & Abu Dhabi By Foot’s Terms and
Conditions. In the event of any conflict between this Agreement and the Terms and Conditions,
this Agreement shall control with respect to assumption of risk, liability, and release of claims.
Acknowledgment and Acceptance
By signing below, or by accepting electronically, Participant acknowledges that they have read,
understood, and voluntarily agree to this Agreement. Participant understands that participation
in the Activities is conditioned upon acceptance of these terms.
